If the Service Provider cannot contact a Customer who is not a Consumer by telephone within three (3) working days of receipt of the order, the order may be cancelled.
- The Contract for Specific Work is concluded when the Customer receives the confirmation referred to in point 20(b).
- The Service Provider reserves the right to refuse to fulfil a Laundry Service Order placed by a Customer who previously paid late for a completed Laundry Service, or where there are reasonable doubts about the authenticity of an electronic Laundry Service Order.
- The Sender may cancel fulfilment of the Laundry Service order before the Driver arrives. Within that period, the Customer may cancel the order and/or place a new one. To do so, the Customer should contact the Service Provider.
- The Driver's arrival time is communicated after each Laundry Service order by telephone conversation, SMS or email.
- The Service Provider gives the Customer the right to view or obtain information by telephone about the content of the Order and the current status of the Service Order.
- To fulfil the Order, the Customer must provide all data necessary for the Service Provider to perform the contract: the Customer's first and last name or company name; address (street, house/unit number, town and postcode); contact telephone number; and other data indicated by the Service Provider through the Online Order Form or during the telephone conversation.
Prices, payment and Handover and Receipt of Laundry
- Individual Laundry services are subject to payment. Information about charges for these services will be displayed so that the Customer can read it before using the services, and within the relevant Online Order Form resources.
- Laundry Service prices are expressed in Polish zloty and are gross prices, i.e. inclusive of VAT.
- The Laundry Service charge is specified in the price list available on www.ciociarenia.pl and at the Laundry. For items not covered by the price list, the Laundry staff determines the price individually before starting the commissioned Laundry Service. Once the price has been determined, a Laundry employee informs the Customer by telephone, SMS or email. The Service Provider starts the Laundry Service after the Customer accepts the price.
- As part of the Laundry Services, the Service Provider offers free Handover and Receipt of Laundry provided that the minimum Laundry Service value is 200.00 PLN gross.
- A Laundry Service order with Handover and Receipt of Laundry worth less than 200.00 PLN results in the service price being increased to 200.00 PLN gross.
- The Customer may pay for the Laundry Service in the following ways:
- in cash upon Receipt of Laundry, at a previously agreed time;
- by payment card upon Receipt of Laundry, at a previously agreed time;
- by bank transfer to the Contractor's bank account stated on the VAT invoice.
- The Service Provider is liable for damage to or loss of Clothing occurring between Handover of Dirty Laundry and Receipt of Laundry by the Customer.
- The standard Laundry Service completion time is 48 hours unless the particular washing/cleaning process requires otherwise. This is the period from Handover of Laundry to Receipt of Laundry, excluding days off work and public holidays. If an Order contains several items of Clothing with different service completion times, Receipt of Laundry takes place after the entire Order has been completed, taking all deadlines into account.
- The Laundry Service completion time for carpets is 8 days unless the particular washing/cleaning process requires otherwise. This is the period from Handover of Laundry to Receipt of Laundry, excluding days off work and public holidays.
- The Service Provider makes every effort to fulfil Orders in the shortest possible time.
- For cash or card payments, the Customer undertakes to pay for the Laundry Service directly to the Driver delivering the Laundry. If the Customer avoids paying for the delivered Laundry, i.e. fails to perform the Contract, the Driver will return the Laundry to the Laundry premises. In that situation, the Service Provider may call upon the Customer to perform the Contract and seek compensation for damage caused by the Customer's non-performance, including, in particular, the costs of transport in both directions and the demand for performance. The fee for additional transport in both directions is 50.00 PLN.
- The Service Provider delivers Laundry using its own transport.
- The Laundry Service completion date will be confirmed during the telephone conversation referred to in § 4 point 20(b) of these Terms and Conditions
- The ordered Laundry Service may be performed by the Service Provider only at the address specified by the Customer when placing the Order.
- The Delivery Receipt confirming acceptance of the item for service is the only document authorising collection of that item.
- If the Customer loses the Delivery Receipt, the Driver will release the Clothing only after recording the Customer's details from an identity document
- Upon Receipt of Laundry, we suggest that the Customer check the number of items received. Any discrepancy in quantity must be reported to the Driver at the time of Receipt of Laundry. Receipt of Laundry from the Driver is equivalent to confirmation that the quantity is correct.
- At the time of Receipt of Laundry, the Customer must remove the clothing from the plastic packaging and check its contents. If damage is found, the Customer must report it to the Driver and contact the Service Provider immediately. Complaints about damage to Clothing will be considered only after a written complaint from the Customer.
- For each transaction, the Service Provider prints a fiscal receipt or, at the Customer's request, a VAT invoice.
The Consumer's right to withdraw from the Contract (cancellation of the Laundry Service)
- The Consumer may withdraw from a distance Contract for Specific Work without giving a reason by submitting an appropriate statement before the Driver arrives to collect the laundry; this period begins when the contract is concluded. To meet the deadline, it is sufficient to send the statement to the Service Provider's address before the period expires. The Customer may exercise this right by sending a statement of withdrawal from the Laundry Services contract by SMS to +48 787 718 538 and +48 664 020 838.
- If the Customer withdraws from a distance Laundry Service Contract, the contract is considered not to have been concluded.
- If the Customer submits a statement withdrawing from the Contract for Specific Work before the Service Provider accepts the offer, the offer ceases to be binding.
- The Customer's obligations after withdrawal from the Contract if the Driver has travelled to the Handover location:
- The Customer bears the direct cost of the Driver's travel, amounting to 50.00 PLN.
- Statutory exclusion of the right to withdraw from the Contract:
The Consumer has no right to withdraw in the situations specified in Article 38 of the Act, i.e. in relation to contracts:- for the provision of services, if the Service Provider has fully performed the service with the Consumer's express consent and the Consumer was informed before performance began that they would lose the right to withdraw once the Service Provider had performed the service.
Complaints
- The following clothing is cleaned solely at the Customer's risk: clothing without manufacturers' washing labels, leather clothing, clothing with natural leather or synthetic inserts, clothing with sequin or bead appliqués, and wedding dresses.
- The Service Provider is not liable for damage that could not have been foreseen before acceptance of the item:
- damage caused by incorrect information provided by the manufacturer on cleaning conditions for clothing covered by the Laundry Service,
- incorrect information provided by the Customer in the order,
- hidden defects in the materials from which items covered by the Laundry Service are made.
- inadequate quality of the materials from which items covered by the Laundry Service are made.
- The Service Provider is not responsible for items left in Clothing covered by the Laundry Service.
- The Service Provider informs the Customer that Laundry Services are additionally provided under the conditions below, to which the Customer agrees:
Washing/cleaning does not restore Clothing to its original condition at manufacture; it only refreshes its appearance, taking account of its condition when handed over to the Laundry.
- The Service Provider undertakes to perform the commissioned Services with the utmost care, but does not guarantee complete removal of stains and soiling, particularly old stains or stains previously treated by washing.
- In the event described in point 3 above, the Service Provider accepts liability as specified in Articles 471–472 of the Civil Code.
- The Customer must check the quality of the Laundry Service and the quantity of Clothing on the spot at the time of Receipt of Laundry; otherwise, the Service will be deemed to have been performed correctly.
- The Customer may submit a complaint no later than 3 days after Receipt of Laundry if the grounds for the complaint become known only after Receipt of Laundry. In that case, the complaint must be in writing and submitted to the Service Provider's address no later than 3 days after the date of Receipt of Laundry.
- The Service Provider undertakes to consider each complaint within 14 days. Neither expiry of the complaint submission period nor a decision by the Service Provider rejecting a complaint deprives the Customer of the right to pursue appropriate claims before the competent court under general rules. The Service Provider considers complaints upon receipt of a written complaint accompanied by a fiscal receipt or VAT invoice.
- The Service Provider undertakes to compensate for any damage resulting from non-performance or improper performance of an obligation on the terms (including exceptions) provided for in Articles 471 and 472 of the Civil Code, subject to the reservations contained therein.
- A Customer submitting a Laundry complaint must demonstrate the actual value of the Clothing with a document (VAT invoice or other proof of purchase). If no such document is available, other credible evidence must be provided to establish that value beyond doubt. When valuing Clothing, factors such as market value, period of use and wear are taken into account.
- If the Customer receives full compensation for Clothing (based on its value on the date of Handover of Dirty Laundry, accounting for wear since purchase), the Clothing remains at the Laundry. If Clothing has lost part of its value, the Customer is entitled to its return and partial compensation.
- If the Customer does not collect the Clothing within 14 days of the date specified for completion of the service, the clothing will be handed over to the lost property office.
The Service Provider's liability for operation of the Online Order Form
- The Service Provider takes steps to ensure the fully correct operation of the Online Order Form in accordance with current technical knowledge and undertakes to promptly remove all irregularities reported by customers.
- The Customer's right to submit a complaint under this section applies solely to irregularities, faults or interruptions in the operation of the Online Order Form.
- When using the Online Order Form service, the Customer should immediately notify the Service Provider of any irregularities, faults or interruptions they identify in its operation and of any inadequate quality of the Online Order Form.
- The Customer may report irregularities in the operation of the Online Order Form in writing to F.H.U. Homecomfort Marcin Data, ul. Piotra Wysockiego 2, 31-310 Kraków, or by email to: [email protected]
